Section-1(Maternity Leave)
In this section, we will come to know about the following things:-
- What is Maternity Leave?

Now let's discuss both of the above sections one by one. Let's start with Section-1 which is about maternity leave. Maternity leave provisions are provided in rule 8.127(a) in the Punjab Civil Service Rules volume 1 part 1. We will study this rule in the following manner:-

What is Maternity leave?
In simple words, Maternity leave is a leave granted to a female government employee when she is pregnant and when she gives birth to a child
For how much period it can be taken?
Maternity leave may be granted to a female government employee for a maximum period of 180 days by the competent authority.
Does a medical certificate is necessary to take this leave?
No. Medical certificate is not necessary for the approval of this leave as in the case of commuted leave. It can be availed without the necessary production of medical certificate only the condition is the date of confinement falls within the period of this leave.
Can leave so availed be debited to leave account?
No. Maternity leave will not be debited to leave the account of a female government employee.
Can this leave also be granted in case of miscarriage or abortion?
As per note 2 below rule 8.128(a) of the Punjab CSR volume 1 part 1, maternity leave may also be granted to a female government employee having less than two surviving children in case of miscarriage or abortion subject to the condition that leave does not exceed six weeks and application is supported by a medical certificate.Can maternity leave be extended?
Yes. This leave can be extended after the expiry of 180 days by granting leave of the kind due as per note under rule 8.128(a) of ibid. But any leave applied for in continuation of maternity leave may be granted only if the request is supported by a medical certificate as per rule 8.128(b) of ibid.
Can regular leave be taken in case of illness of a newly born baby?
Yes, regular leave can be availed. But the female Government employee has to produce a medical certificate from the authorized medical attendant to the effect that the condition of the ailing baby warrants mother‟s personal attention and her presence by the baby‟s side is absolutely necessary.
Section -2(Paternity Leave)
What is Paternity Leave?
It is a kind of leave that a male government employee can avail when he is in the state of being someone's father. As per rule 8.128 of the ibid, this leave shall be admissible during the confinement of his wife for childbirth upto 15 days before or upto 15 days after the date of delivery of the child.
For how many days it can be availed?
This leave can be availed for a maximum period of 15 days.
May paternity leave be granted to an employee already have two living children?
No, Only a male government employee having less than two surviving children may be granted this leave. As per note under rule 8.128 of ibid
Can this leave will be debited to leave account?
Yes, A male government employee who will avail this leave will have to deduct 30 half pay leaves from his leave account by commuting those 15 days.
How much salary will be admissible during this leave?

can employee take leave just after one or two days after delivery? Eg. The baby born on 01-03-2021 and he take causal leave for 2-03-2021 and present in the office at 03-03-2021 and apply leave from 04-03-2021. Please clarify this
